Terms and Conditions
1. Use and nature of our services
1.1 These terms and conditions constitute the legally binding agreement between a customer (“you”) and Justitia ehf. (hereinafter referred to as “the company”), ID no. 690922-0450, with regard to the provision of our services.
1.2 By accepting these terms and conditions, the customer agrees to be bound by them, as well as by the company´s pricing, any additional terms that may apply to the selected service, and the company’s privacy statement.
1.3 We recommend that the customer refrains from using the services until they have read and understood these terms and conditions, the privacy statement, and the company’s pricing.
1.4 Should any questions arise regarding these terms and conditions, customers are encouraged to contact the company via email at farbaetur@teal-gerbil-896825.hostingersite.com and to review the information available on the company’s website.
2. Fees and payment
2.1 The customer pays no fee if no compensation is recovered on the claim.
2.2 If the claim is successful, the company charges a fee of 25% of the compensation received.
2.3 The remaining amount is transferred to the customer’s bank account.
3. Service
3.1 By accepting these terms and conditions, the customer assigns their claim against the airline to the company, which undertakes to collect the claim on the customer’s behalf.
3.2 The company only pursues standard compensation in accordance with Regulation (EC) No. 261/2004.
3.3 The company does not pursue compensation for consequential or indirect damages suffered by the customer as a result of an incident covered by the regulation, unless expressly agreed otherwise.
4. Pricing
4.1 The company charges a 25% fee on the compensation amount paid by the airline. The final amount paid to the customer depends on the exchange rate used by the airline or payment service provider at the time of payment.
For instance: If compensation of EUR 600 is paid, the amount paid to the customer will be ISK 62,701.
If compensation of EUR 400 is paid, the amount paid to the customer will be ISK 41,820.
If compensation of EUR 200 is paid, the amount paid to the customer will be ISK 20,910.
5. Right of withdrawal
5.1 Upon signing the agreement, the customer has 14 days to withdraw from the contract.
5. 2 Notice shall be delivered to the email address farbaetur@farbaetur.is within fourteen (14) days from the date on which the claim was assigned
6. Handling of claims
6.1 If the airline rejects the claim, the company reserves the right to take no further action, in which case the agreement shall be deemed terminated.
6.2 Any appeal to the Icelandic Transport Authority shall be made in consultation with the customer.
6.3 Legal proceedings shall never be initiated without consultation with the customer.
6.4 If the customer has already received compensation from the airline in respect of an incident, the company shall not pursue a claim arising from the same incident, provided that such compensation has been paid for the benefit of that customer. This shall not prevent the processing of a claim arising from the same incident where another person is involved and has not received compensation.

6.5 If a determination is sought in relation to a dispute concerning compensation, such determination shall, in consultation with the customer, first be sought from the Icelandic Transport Authority (Samgöngustofa).
7. Liability
7.1 The company shall not be liable if the processing of a claim takes longer than expected.
7.2 The company shall not be liable if compensation is not recovered.
8. Jurisdiction and applicable law
8.1 These terms and conditions shall be governed by and construed in accordance with Icelandic law. In the event of any dispute arising out of or in connection with these terms and conditions, the parties shall seek to resolve the dispute amicably.
8.2 If amicable settlement efforts are unsuccessful, the dispute shall be submitted to the District Court of Reykjavík (Héraðsdómur Reykjavíkur).
